Terms and Conditions for Booking of Mare(s)
(1) The service fee shall be due and payable immediately when the mare produces a live foal as a result of this mating. A live foal is one that can stand up alone and nurse. Payment of service fee shall be made to the order of Sugar Valley Farm, LLC. If the stud fee is not paid within 30 days of foaling, any loyalty discount may be forfeited and the full stud fee plus a 2% monthly service charge will apply.
(2) THE SERVICE FEE IS DUE AND PAYABLE IMMEDIATELY IF THE MARE OR RECIPIENT MARE IS LEASED OR OFFERED FOR SALE OR IF THERE IS A CHANGE IN OWNERSHIP OF THE MARE OR RECIPIENT. NO REFUND SHALL BE DUE TO ANY PERSON, UNDER ANY CIRCUMSTANCES.
(3) In all cases where transported semen or transient (“trailer”) breeding is requested, the mare owner agrees that all costs relating to these procedures (other than the actual service fees), shall be paid by either VISA, MASTERCARD, AMERICAN EXPRESS or CASH before delivery of the semen.
(4) In all cases where transported semen breeding is requested, the person performing the artificial insemination assumes FULL responsibility of cross referencing the mare’s freeze brand/tattoo with the label on the syringe shipped by Sugar Valley Farm, LLC and must inseminate the mare with semen of the contracted stallion.
(5) If using FedEx for semen delivery, the mare owner must have a valid FedEx account number.
(6) Neither Sugar Valley Farm, LLC nor its directors, agents, or employees, shall be liable for any injury, disability or death suffered by any horse, from any cause whatsoever, while in the custody of Sugar Valley Farm, LLC and the undersigned owner specifically assents to such conditions, and waives any claim from damages resulting from any such injury, disability, or death.

(7) All mares must be standard and registered with the U.S.T.A. Agent/Owner agrees that they are an active member in good standing with the USTA and must maintain that membership throughout the entirety of this contract. A person not in good standing is defined by the USTA rule4.192 per USTA rule 20.17, Agent/Owner must notify the USTA as well as Sugar Valley Farm LLC if they become a member not in good standing. Sugar Valley Farm LLC will not service the mare if the membership status changes.

(8) In order to secure payment of agreed upon stud fee, the OWNER hereby consents that SUGAR VALLEY FARM, LLC shall have a “Lien on Livestock” or security interest on the mare and any foal resulting from the service for any outstanding or unpaid charges due but not limited to the stud fee, boarding charges, medication and/or veterinary services. Whether or not the mare or foal are at Sugar Valley Farm, LLC the OWNER further consents to pay for all attorney’s fees incurred by Sugar Valley Farm, LLC in the event counsel is retained to collect any outstanding balance due under this contract.
(9) The opening and closing of the breeding season shall be determined by the Farm and shall conform to the USTA and State of Ohio.
The undersigned owner of the mare hereby applies based on the information supplied above, for a booking to the above stallion for this mare. The owner of the above mare has read the attached terms and conditions below and agrees to it fully. If Sugar Valley Farm and it's affiliates approve such booking, then this document will become a contract between the farm and the undersigned.
